Terms of Service

These terms govern your use of the Setlist iOS app, Apple Watch app, website, and connected services.

Acceptance and eligibility

By accessing or using Setlist, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

You must be at least 13 years old, or the minimum age required in your country to use an online service. If you are not legally able to enter a binding agreement, a parent or legal guardian must accept these terms for you. If you use Setlist for an organization or band, you confirm that you are authorized to accept these terms on its behalf.

Accounts

You may need to sign in with Apple, Google, or another supported provider. You must provide accurate account information, maintain the security of your device and credentials, and promptly tell us if you believe your account has been accessed without permission.

You are responsible for activity performed through your account, except to the extent caused by our failure to use reasonable security measures. You may not sell, transfer, or lend your account to another person. We may require you to verify account ownership before restoring access or acting on a request.

Beta testing program

The Setlist web app is available to use now. The iPhone and Apple Watch app, and later the Android app, are offered through beta testing programs. When you submit the beta request form with your email and chosen platform, you are asking us to enroll you in that program, and you consent to us contacting you about your invite and the beta.

To enroll you, we add your email address to the relevant platform's testing tool by hand: Apple TestFlight for iOS, or Google Play testing for Android. Your use of the beta app is also subject to that platform's own terms. Enrollment is not guaranteed or immediate; we review and add testers over time, and spots may be limited.

Beta software is pre-release and may be unstable, incomplete, or changed or discontinued at any time, and it may contain errors that affect your data. Do not rely on a beta build as the only copy of anything important. You can ask us to remove you from the testing list at any time using the contact form. Our Privacy Policy explains how we handle the email you submit.

Band collaboration

Setlist lets people create and join shared band workspaces. Content in a band may be viewed, edited, reorganized, exported, or deleted by members according to their role and the controls available in the product. Changes by one member can affect every member's view of a gig, setlist, library, artwork, or other shared content.

Band owners and administrators are responsible for inviting the right people, assigning suitable access, and resolving internal decisions about ownership and use of band material. We are not a party to disputes among band members and generally will not decide who owns a band name, arrangement, payment note, recording, artwork, or other shared material.

If you leave or are removed from a band, you may lose access to its content. Shared content may remain available to the band and its authorized members. If the only administrator leaves, we may preserve the workspace, transfer administrative control when reasonably supported by the available evidence, or remove it.

Your content

You retain ownership of content you submit to Setlist, including band information, gigs, songs, notes, files, images, prompts, and artwork, to the extent you own it. You grant Setlist a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, transmit, display, and otherwise use that content only as needed to operate, secure, improve, and provide the service and the features you request.

You confirm that you have the rights and permissions needed to upload or share your content and to grant this license. Do not upload copyrighted charts, lyrics, recordings, photos, logos, personal information, or other material unless you are allowed to use and share it.

You are responsible for maintaining any backup you need. AI-assisted and generated results may be inaccurate, incomplete, similar to third-party material, or unavailable for exclusive use. Review outputs before publishing or relying on them.

Acceptable use

You may not use Setlist to:

  • violate law, intellectual-property rights, privacy rights, publicity rights, contracts, or another person's rights;
  • harass, threaten, exploit, impersonate, defraud, or expose another person's sensitive information;
  • upload malware, harmful code, illegal content, or material designed to disrupt or damage systems;
  • probe, bypass, disable, or interfere with security, access controls, rate limits, authentication, or service operation;
  • scrape, crawl, harvest, reverse engineer, or access the service by automated means except through interfaces we authorize or as applicable law permits;
  • send spam, create deceptive invitations, abuse AI or storage features, or consume unreasonable service resources; or
  • help another person do any of the above.

We may investigate suspected violations, remove or restrict content, limit features, or cooperate with lawful requests when reasonably necessary to protect Setlist, its users, or others.

Third-party services and AI features

Setlist uses or connects to third-party services such as Apple, Google, hosting and storage providers, analytics tools, feedback tools, and AI providers. Their services and terms may apply separately. We do not control third-party products and are not responsible for their independent acts, availability, or content.

When you request an AI feature, relevant prompts, text, files, or images may be sent to the provider needed to complete the request. Do not submit confidential or sensitive material unless you understand and accept that processing. AI features are provided for assistance and creative exploration, not as professional, legal, financial, safety, or factual advice.

Termination

You may stop using Setlist at any time and may request account deletion through our contact form. Deleting an app from your device or signing out does not by itself delete server-side data.

We may suspend or terminate access, remove content, or limit features if you materially or repeatedly violate these terms, create risk or legal exposure, fail to pay an applicable fee, abuse the service, or if we discontinue Setlist. When reasonable, we will provide notice and an opportunity to export content, but urgent security, legal, or abuse situations may require immediate action.

Provisions that by their nature should survive termination, including ownership, licenses already required to complete processing, disclaimers, liability limits, indemnity, and governing law, will survive.

Service availability and changes

Setlist may change, add, remove, limit, or discontinue features, integrations, storage, usage limits, beta access, or device support. We may perform maintenance or experience interruptions, data delays, sync conflicts, failed notifications, or third-party outages. We do not promise that the service will always be available, error-free, secure, or compatible with every device.

Do not rely on Setlist as the only copy of information essential to safety, payment, travel, contractual obligations, or a performance. Keep an appropriate offline or printed fallback for situations where device, battery, network, or service failure would cause significant harm.

Disclaimers

To the maximum extent permitted by law, Setlist is provided “as is” and “as available.” We disclaim all express or implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and that content will not be lost or altered.

Setlist does not guarantee that a setlist, cue, key, tempo, notification, invitation, generated result, or other content is correct or suitable for a particular performance. You are responsible for checking the information your band relies on.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you. Nothing in these terms limits rights that cannot lawfully be waived.

Limitation of liability

To the maximum extent permitted by law, Setlist and its owner, developers, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, opportunities, performances, bookings, or business interruption, arising from or related to the service, even if advised that such harm was possible.

To the maximum extent permitted by law, our total liability for all claims arising from or related to Setlist will not exceed the greater of: (a) the amount you paid us for Setlist during the 12 months before the event giving rise to the claim; or (b) US $100.

These limits do not apply to liability that cannot be limited under applicable law, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where exclusion is prohibited.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Setlist and its owner, developers, affiliates, and service providers from third-party claims, damages, losses, and reasonable costs arising from your content, your unlawful or unauthorized use of the service, your violation of these terms, or your violation of another person's rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.

Governing law and disputes

These terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Subject to any mandatory consumer rights that allow you to bring a claim elsewhere, the competent courts located in Tel Aviv-Jaffa, Israel will have exclusive jurisdiction over disputes arising from or related to these terms or Setlist.

Before filing a formal claim, you and Setlist agree to make a good-faith effort to resolve the dispute by contacting the other party and allowing 30 days for a response. Either party may seek urgent injunctive or protective relief when necessary.

Changes, general terms, and contact

We may update these terms as Setlist, our business, or legal requirements change. We will post the revised terms here and update the effective date. If a change is material, we will provide additional notice when reasonably possible. Continuing to use Setlist after updated terms take effect means you accept them.

If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the service.
